Your Case in General District Traffic/ Criminal
Court

Dear Mr. Cardon,
Last month I was pulled over for driving
on a suspended license and speeding, 45
mph in a 35 mph zone. My court date is set
for later this week in Norfolk General District
Traffic Court, and I have not had a chance
to hire an attorney. I'm planning to ask
the judge for a continuance. What is the
procedure and what can I expect? -Wanda
Most General District Traffic and Criminal
courts in Virginia have different procedures
for granting a continuance. You should always
call the clerk's office for your court to
find out the specific procedures. With that
in mind, however, there are some general
tips you can follow that will apply to most
General District Traffic and Criminal court
requests for continuances.
Tip #1: Don't drive to court if
your driver's license is suspended or revoked.
Judges often ask defendants how they got
to court. Especially if the defendant's
charge is driving without a license or driving
on a suspended or revoked driver's license.
Police officers might follow defendants
who they know do not have a license out
of the courtroom and to the court parking
lot to see if they are driving. Therefore,
if you do not have a valid license, or your
license has been suspended or revoked, always
get a friend or relative to drive you, take
a cab, or use public transportation to get
to court.
Tip #2: Arrive early. You
will want to make sure that you leave enough
time for traffic, parking, and time for
getting lost. Arrive at court fifteen minutes
early. If you are late, you might be convicted
by the judge in your absence.
