Virginia Beach Can Tack $100 Fee on to DUI Conviction

Dear Mr. Cardon,
I was convicted for Driving Under the Influence (“DUI”) in Virginia Beach recently. The judge imposed a fine of $250, plus court costs, a jail sentence of ninety days suspended, and loss of license for one year. A few weeks after my conviction, I received an invoice from the City of Virginia Beach telling me I own $100 for “DUI Response Reimbursement.” Can you please tell me what this charge is all about? I have already paid a $250 fine plus court costs imposed by the judge. Is this some sort of mistake?

No, the $100 charge is not a mistake. In the Virginia Beach City Counsel has enacted Virginia Beach City Code Section 21-344 which allows the city to be reimbursed for the reasonable expense of “appropriate emergency response, (police fire, emergency medical personnel and equipment used) in connection with a Driving Under the Influence arrest and conviction.” According to the code section, the reimbursement amount cannot exceed one thousand dollars ($1000). Apparently, in your case, the city has determined that the appropriate emergency response in connection with your DUI was worth $100.

Reimbursement is not limited solely to cases involving automobiles. The section applies to operation of a motor vehicle, engine, train or watercraft while impaired.

Once you receive the invoice you have 30 days to pay the bill to the City of Virginia Beach Treasurer or a late penalty of $20.00 may be added to your bill. more>>
