Reckless
Driving: More Serious Than You Might Think
by David A. Cardon, Esquire
Dear Mr. Cardon,
I was arrested on Groundhog’s day
for reckless driving. Apparently, a state
trooper was following me when I was driving
on the interstate between Norfolk and Virginia
Beach. He said I was going 80 mph in a 55
mph zone. I wanted to just pay off the ticket
so that I would not have to take time off
from work, but the officer said I have to
appear in court on the return date. Someone
at work told me I could go to jail for this.
Is this true?
Yes, you can go to jail for reckless driving
in Virginia. There are over fifteen statutes
in the Virginia Code that cover reckless
driving. The violation of any of those statutes
is a Class 1 Misdemeanor punishable up to
one year in jail and up to a $2,500 fine.
The following are a few offenses considered
to be reckless driving:
Reckless driving generally
– driving recklessly or at a speed
or in a manner so as to endanger the life,
limb, or property of any person.
Faulty brakes – driving
a vehicle which is not under proper control
or which has inadequate or improperly adjusted
brakes.
Driver's view obstructed
– driving a vehicle that is so loaded
or when there are so many people in the
front seat that the driver's view of the
road to the front or sides of the vehicle
is obstructed. more>>
