Shoplifting Does Not Pay in Virginia

Dear Mr. Cardon,
Recently I was shopping at a store in Virginia
Beach with my 20-year-old brother. After
left the store I was surprised to discover
my brother had stolen a few items from the
store. I want my brother to know the consequences
he would face if he were caught shoplifting.
Please tell me what could have happened
to him if he had been caught.
In Virginia there are a few factors that
determine the punishment for shoplifting.
First, what is the value of the stolen item
or items? Second, have you ever been convicted
of larceny before?
Mr. Cardon replies:
Petit v. grand larceny
- Petit larceny is defined as either (1)
taking property with a value under $5 from
the body of a person, or (2) taking property
with a value under $200 belonging to someone
else. Grand larceny is defined as taking
property with a value over $5 from the body
of a person, or (2) taking property with
a value over $200 belonging to someone else,
or (3) taking a firearm from another, regardless
of the firearm's value.
Punishment for larceny
- The punishment for petit larceny is a
class one misdemeanor. A class one misdemeanor
carries up to one year in jail and up to
a $2500 fine. The punishment for grand larceny
is not less than one but no more than twenty
years in state prison or, depending on the
jury or judge, jail for no more than twelve
months and no more than $2500 fine. more>>
